血圧計等の製造の事業を行う者の再生資源の利用の促進に関する判断の基準となるべき事項を定める省令 再生資源の利用の促進に関する法律（平成三年法律第四十八号）第十三条の規定に基づき、家庭用電気治療器の製造の事業を行う者の再生資源の利用の促進に関する判断の基準となるべき事項を定める省令を次のように制定する。 （構造の工夫） 第一条 血圧計等（血圧計、医薬品注入器、電気マッサージ器、家庭用電気治療器又は電気気泡発生器（浴槽用のものに限る。）をいう。以下同じ。）の製造の事業を行う者（以下「事業者」という。）は、血圧計等に使用される密閉形蓄電池（密閉形鉛蓄電池（電気量が二百三十四キロクーロン以下のものに限る。）、密閉形アルカリ蓄電池又はリチウム蓄電池をいい、機器の記憶保持用のものを除く。以下同じ。）の再生資源としての利用を促進するため、はんだ付けによらない密閉形蓄電池の取付け方法の採用、密閉形蓄電池の取り外しが消費者又は当該血圧計等の保守点検の事業を行う者にとって容易である構造の採用その他の構造の工夫を行うものとする。 （再生資源の利用の促進のための表示等） 第二条 事業者は、血圧計等に使用される密閉形蓄電池の再生資源としての利用を促進するため、当該機器が密閉形蓄電池を使用する機器である旨その他の密閉形蓄電池の再生資源としての利用の促進に係る事項の血圧計等及びそれに付属する取扱説明書その他の物品への表示又は記載を行うものとする。 （安全性等の配慮） 第三条 事業者は、前二条の規定に即して血圧計等に使用される密閉形蓄電池の再生資源としての利用を促進する際には、血圧計等の安全性及び耐久性その他の必要な事情に配慮するものとする。 （技術の向上） 第四条 事業者は、血圧計等に使用される密閉形蓄電池の再生資源としての利用を促進するため、必要な技術の向上を図るものとする。 （事前評価） 第五条 事業者は、血圧計等の設計に際して、血圧計等に使用される密閉形蓄電池の再生資源としての利用を促進するため、第一条及び第二条の規定に即して、あらかじめ血圧計等の評価を行うものとする。 ２ 事業者は、前項の評価を行うため、血圧計等の評価項目、評価基準及び評価方法を定めることとする。 ３ 事業者は、第一項の評価を行うに際し、必要な記録を行うものとする。 （情報の提供） 第六条 事業者は、血圧計等の構造、使用される密閉形蓄電池の取り外し方法その他の血圧計等に使用される密閉形蓄電池の再生資源としての利用の促進に資する情報の提供を行うものとする。 附 則 この省令は、公布の日から施行する。 附 則 この省令は、平成十三年四月一日から施行する。
