硬質塩化ビニル製の管又は管継手の製造業に属する事業を行う者の使用済硬質塩化ビニル製の管又は管継手の利用に関する判断の基準となるべき事項を定める省令 資源の有効な利用の促進に関する法律（平成三年法律第四十八号）第十五条第一項の規定に基づき、硬質塩化ビニル製の管又は管継手の製造業に属する事業を行う者の使用済硬質塩化ビニル製の管又は管継手の利用に関する判断の基準となるべき事項を定める省令を次のように定める。 （使用済硬質塩化ビニル製の管又は管継手の利用） 第一条 硬質塩化ビニル製の管又は管継手の製造業に属する事業を行う者（以下「事業者」という。）は、単独に又は共同して、建設業に属する事業を行う者、国及び地方公共団体と協力しつつ、技術的かつ経済的に可能な範囲で、硬質塩化ビニル製の管又は管継手の製造に使用する原材料の総重量のうち当該製造に使用する使用済硬質塩化ビニル製の管又は管継手（以下「使用済管等」という。）の総重量の占める比率を向上させるものとする。 （設備の整備） 第二条 事業者は、使用済管等を利用するため、異物除去設備、粉砕設備その他の必要な設備を整備するものとする。 （技術の向上） 第三条 事業者は、使用済管等を利用するため、次に掲げる技術を向上させるものとする。 一 種類が異なるプラスチック製の管又は管継手から使用済管等を効率的に選別する技術 二 使用済管等から砂、ゴムその他の異物を効率的に除去する技術 三 品質が劣化した使用済管等を利用することができる技術 四 その他の使用済管等を利用するために必要な技術 （使用済管等の利用計画） 第四条 事業者は、使用済管等の利用を計画的に行うため、毎事業年度開始前に、その事業年度の使用済管等の利用に関する計画（以下「使用済管等利用計画」という。）を作成するものとする。 ２ 使用済管等利用計画には、次に掲げる事項を記載するものとする。 一 使用済管等を利用するために必要な設備の整備に関する事項 二 使用済管等を利用するために必要な技術の向上に関する事項 三 前二号に掲げるもののほか、使用済管等の利用に関する事項 ３ 事業者は、使用済管等利用計画の実施の状況について、記録を行うものとする。 （情報の提供） 第五条 事業者は、硬質塩化ビニル製の管又は管継手の需要者の使用済管等の利用に関する理解を深めるため、製造する硬質塩化ビニル製の管又は管継手の品質その他の必要な情報の提供を行うものとする。 附 則 この省令は、平成十三年四月一日から施行する。
