Covered Products
- ·Products that generate waste ('produits générateurs de déchets') containing substances of very high concern (SVHC) listed under REACH Article 59(1) (Candidate List)
- ·Products that generate waste containing substances of comparable concern to SVHCs not on the REACH Candidate List, as defined by ministerial order
Producer Obligations
- ·Identify dangerous substances present in waste-generating products, specifically: (1) SVHCs on the REACH Candidate List (REACH Regulation (EC) No 1907/2006, Article 59(1) and 59(10)), and (2) substances of comparable concern not on the Candidate List as defined by ministerial order following ANSES opinion

Article 1 Les substances dangereuses mentionnées à l' article L. 541-9-1 du code de l'environnement sont les substances suivantes : - substances extrêmement préoccupantes inscrites sur la liste mentionnée à l'article 59, paragraphe 1, du règlement (CE) n° 1907/2006 et publiée conformément à l'article 59, paragraphe 10, du règlement (CE) n° 1907/2006 ; - substances présentant un niveau de préoccupation comparable aux substances extrêmement préoccupantes qui ne sont pas sur la liste mentionnée à l'article 59, paragraphe 1, du règlement (CE) n° 1907/2006. La liste de ces substances et sa mise à jour sont fixées par arrêté du ministre chargé de l'environnement après avis de l'Agence nationale de sécurité sanitaire de l'alimentation, de l'environnement et du travail. Article 2 La ministre de la transition écologique est chargée de l'exécution du présent décret, qui sera publié au Journal officiel de la République française.
