Fee Structure

Per Ton: Net saving per tonne rates payable by waste disposal authorities to waste collection authorities: Inner London borough area waste disposal authorities and inner London borough councils and Common Council of the City of London: £64.22/tonne; Outer London borough waste disposal authorities and outer London borough councils: £57.20/tonne; Greater Manchester Waste Disposal Authority, Merseyside Waste Disposal Authority, and metropolitan district councils: £48.82/tonne; Any other waste disposal authority: £40.41/tonne where the authority incurs transport costs in disposing of similar wastes, or £30.61/tonne in other cases. Rates increased by 3.5% to reflect RPI rises and landfill tax increase to £18/tonne.

Title and commencement

These Regulations may be cited as the Environmental Protection (Waste Recycling Payments) (England) (Amendment) Regulations 2005 and shall come into force on 1st April 2005.

Amendment of regulations

For the Schedule to the Environmental Protection (Waste Recycling Payments) (England) Regulations 2004 substitute–

These Regulations substitute a new Schedule for that in the Environmental Protection (Waste Recycling Payments) (England) Regulations 2004, which make provision for determining the net savings of expenditure payable by waste disposal authorities to waste collection authorities and other persons who collect and retain waste for recycling (regulation 2).

The new Schedule provides figures for determining the net saving of expenditure where this cannot otherwise be determined because sufficient accurate information is not available or could only be obtained at a disproportionate cost. These figures are increased to take account of rises in the Retail Price Index (by 3.5%) and increases in landfill tax (to £18 a tonne).

A Regulatory Impact Assessment has not been prepared for this instrument as it has no impact on the costs of the public sector, business, charities or voluntary bodies.
