Obligations under this law

Establishes Extended Producer Responsibility framework for textile products (clothing and household textiles) in Netherlands, effective 1 July 2023, requiring producers to manage end-of-life textile collection, sorting, and recycling.

Covered Products

·Newly manufactured textile products in the category of clothing (consumer and business clothing as defined in chapters 61 and 62 of section XI of part II of Annex I to Regulation (EEC) No 2658/87)
·Newly manufactured textile products in the category of household textiles (table, bed and household linen as defined in chapter 63, part I, heading 6302, of section XI of part II of Annex I to Regulation (EEC) No 2658/87)

Producer Obligations

·Ensure that per calendar year at least the required weight percentage of textile products placed on the market in the preceding calendar year is prepared for reuse or recycled (Article 3): 50% in 2025, 55% in 2026, 60% in 2027, 65% in 2028, 70% in 2029, 75% from 2030 onwards
·Ensure that per calendar year at least the required weight percentage of textile products placed on the market in the preceding calendar year is prepared for reuse (Article 4(1)): 20% in 2025, 21% in 2026, 22% in 2027, 23% in 2028, 24% in 2029, 25% from 2030 onwards
·Ensure that per calendar year at least the required weight percentage of textile products placed on the market in the preceding calendar year is prepared for reuse specifically in the Netherlands (Article 4(2)): 10% in 2025, 11% in 2026, 12% in 2027, 13% in 2028, 14% in 2029, 15% from 2030 onwards
·Ensure that per calendar year at least the required weight percentage of recycled textile products is fibre-to-fibre recycled (Article 5): 25% in 2025, 27% in 2026, 29% in 2027, 31% in 2028, 32% in 2029, 33% from 2030 onwards
·Take measures aimed at maximising the use of recycled textile fibres from post-consumer discarded textile products in the textile products placed on the market (Article 6)

(definities en reikwijdte)

In dit besluit en de erop berustende bepalingen wordt verstaan onder:

huishoudtextiel: tafel-, bed- en huishoudlinnen als bedoeld in hoofdstuk 63, deel I, post 6302, van afdeling XI van deel II van bijlage I bij Verordening (EEG) nr. 2658/87 ;

in de handel brengen: voor het eerst in Nederland op de markt aanbieden van een product;

kleding: consumenten- en bedrijfskleding als bedoeld in de hoofdstukken 61 en 62 van afdeling XI van deel II van bijlage I bij Verordening (EEG) nr. 2658/87 ;

op de markt aanbieden: in het kader van een handelsactiviteit, al dan niet tegen betaling, verstrekken van een product met het oog op distributie, consumptie of gebruik;

producent: degene die beroepsmatig, ongeacht de gebruikte verkooptechniek, textielproducten in de handel brengt;

textielproducten: textielproducten als bedoeld in artikel 3, eerste lid, onderdeel a, in samenhang met artikel 2, tweede lid, onderdeel a, van Verordening (EU) nr. 1007/2011 ;

textielvezel: textielvezel als bedoeld in artikel 3, eerste lid, onderdeel b, in samenhang met artikel 5 en bijlage I bij Verordening (EU) nr. 1007/2011 ;

Verordening (EU) nr. 1007/2011:
Verordening (EU) nr. 1007/2011 van het Europees Parlement en de Raad van 27 september 2011 betreffende textielvezelbenamingen en de desbetreffende etikettering en merking van de vezelsamenstelling van textielproducten, en houdende intrekking van Richtlijn 73/44/EEG van de Raad en Richtlijnen 96/73/EG en 2008/121/EG van het Europees Parlement en de Raad (PbEU 2011, L 272);

Verordening (EEG) nr. 2658/87:
Verordening (EEG) nr. 2658/87 van de Raad van 23 juli 1987 met betrekking tot de tarief- en statistieknomenclatuur en het gemeenschappelijk douanetarief zoals deze luidt in het kalenderjaar waarin de textielproducten in de handel worden gebracht (PbEU 1987, L 256);

vezel-tot-vezelrecycling: recycling waarbij textielproducten die afvalstof zijn geworden, worden bewerkt zodat de textielvezels opnieuw worden toegepast in materialen voor kleding of huishoudtextiel;

Dit besluit heeft betrekking op nieuw gefabriceerde textielproducten van de categorieën kleding en huishoudtextiel.

(gemachtigd vertegenwoordiger)

Een producent die niet in Nederland is gevestigd, wijst een in Nederland gevestigde rechtspersoon of natuurlijke persoon aan als gemachtigd vertegenwoordiger voor de uitvoering van de verplichtingen van de producent in verband met dit besluit en het Besluit regeling voor uitgebreide producentenverantwoordelijkheid .

Op de gemachtigd vertegenwoordiger zijn de bij ministeriële regeling vastgestelde vereisten van toepassing.

3
(voorbereiding voor hergebruik en recycling)

Onverminderd de artikelen 4 en 5 draagt de producent er zorg voor dat per kalenderjaar ten minste het volgende gewichtspercentage van het totaal van de door hem in het daaraan voorafgaande kalenderjaar in de handel gebrachte textielproducten wordt voorbereid voor hergebruik of gerecycled:

a.
in 2025: 50 gewichtsprocent;

b.
in 2026: 55 gewichtsprocent;

c.
in 2027: 60 gewichtsprocent;

d.
in 2028: 65 gewichtsprocent;

e.
in 2029: 70 gewichtsprocent;

f.
vanaf 2030: 75 gewichtsprocent.

(voorbereiding voor hergebruik)

De producent draagt er zorg voor dat per kalenderjaar van het totaal van de door hem in het voorafgaande kalenderjaar in de handel gebrachte textielproducten ten minste het volgende gewichtspercentage wordt voorbereid voor hergebruik:

a.
in 2025: 20 gewichtsprocent;

b.
in 2026: 21 gewichtsprocent;

c.
in 2027: 22 gewichtsprocent;

d.
in 2028: 23 gewichtsprocent;

e.
in 2029: 24 gewichtsprocent;

f.
vanaf 2030: 25 gewichtsprocent.

De producent draagt er zorg voor dat per kalenderjaar van het totaal van de door hem in het voorafgaande kalenderjaar in de handel gebrachte textielproducten ten minste het volgende gewichtspercentage wordt voorbereid om te worden hergebruikt in Nederland:

a.
in 2025: 10 gewichtsprocent;

b.
in 2026: 11 gewichtsprocent;

in 2027: 12 gewichtsprocent;

(vezel-tot-vezelrecycling)

De producent draagt er zorg voor dat per kalenderjaar van het totaal van de door hem in het voorafgaande kalenderjaar in de handel gebrachte textielproducten die worden gerecycled ten minste het volgende gewichtspercentage vezel-tot-vezel wordt gerecycled:

a.
in 2025: 25 gewichtsprocent;

b.
in 2026: 27 gewichtsprocent;

c.
in 2027: 29 gewichtsprocent;

d.
in 2028: 31 gewichtsprocent;

e.
in 2029: 32 gewichtsprocent;

f.
vanaf 2030: 33 gewichtsprocent.

(toepassing gerecyclede textielvezels)

De producent neemt maatregelen die erop zijn gericht dat in textielproducten die hij in de handel brengt zo veel mogelijk gerecyclede textielvezels afkomstig van na gebruik afgedankte textielproducten worden toegepast.

(verslaglegging)

Het verslag, bedoeld in artikel 5 van het Besluit regeling voor uitgebreide producentenverantwoordelijkheid , wordt jaarlijks voor 1 augustus over het voorafgaande kalenderjaar uitgebracht.

In afwijking van artikel 5, eerste lid, van het Besluit regeling voor uitgebreide producentenverantwoordelijkheid kan in het verslag over de jaren 2023 en 2024 worden volstaan met vermelding van de hoeveelheid in de handel gebrachte textielproducten.
