제1조(목적) 이 규칙은 「자원의 절약과 재활용촉진에 관한 법률」 제9조에 따라 포장폐기물의 발생을 억제하고 재활용을 촉진하기 위하여 제품을 제조ㆍ수입 또는 판매하는 자가 지켜야 할 제품의 포장재질ㆍ포장방법에 관한 기준 및 합성수지재질로 된 포장재의 연차별 줄이기 기준 등에 관한 사항을 규정함을 목적으로 한다.
제2조(적용 범위)
① 수송을 목적으로 하는 제품포장에는 이 규칙을 적용하지 않는다.
② 제1항에도 불구하고 「소비자기본법」에 따른 소비자에게 수송하기 위한 목적의 제품포장에 대해서는 제4조를 적용한다.
제3조(제품의 포장재질에 관한 기준)
① 제품을 제조ㆍ수입 또는 판매하는 자(이하 "제조자등"이라 한다)는 재활용이 쉬운 포장재를 사용하고, 중금속이 함유된 재질의 포장재를 제조하거나 유통시키지 아니하도록 하며, 제2항에 따른 권장기준을 준수하도록 노력하여야 한다.
② 기후에너지환경부장관은 포장재의 재활용을 어렵게 하는 중금속의 종류ㆍ농도 및 시험방법 등에 관하여 제조자등에게 적용할 권장기준을 정하여 고시하여야 한다. 이 경우 기후에너지환경부장관은 미리 산업통상부장관과 협의하여야 한다.
③ 제조자등은 폴리비닐클로라이드를 사용하여 첩합(래미네이션)ㆍ수축포장 또는 도포(코팅)한 포장재(제품의 용기 등에 붙이는 표지를 포함한다)를 사용해서는 아니 된다. 다만, 다음 각 호의 제품에 폴리비닐클로라이드를 사용하여 수축포장한 포장재를 사용하지 아니하면 포장재의 기능에 장애를 일으킬 우려가 있는 경우에는 폴리비닐클로라이드를 사용하여 수축포장한 포장재를 사용할 수 있다.
1. 「석유 및 석유대체연료 사업법」 제2조제2호에 따른 석유제품
2. 「약사법」 제2조제4호에 따른 의약품
3. 동물유 및 식물유
4. 화공약품 및 농약
5. 냉동이 필요한 제품
④ 제조자등은 다음 각 호의 제품을 포장할 때에는 폴리비닐클로라이드 포장재를 사용해서는 아니 된다.
1. 계란ㆍ메추리알
2. 튀김식품ㆍ김밥류ㆍ햄버거류ㆍ샌드위치류
제4조(제품의 포장방법에 관한 기준)
① 제조자등은 제품을 포장할 때에는 포장재의 사용량과 포장횟수를 줄여 불필요한 포장을 억제하여야 한다.
② 「자원의 절약과 재활용촉진에 관한 법률 시행령」(이하 "영"이라 한다) 제7조제2호에 따른 제품의 제조자등이 지켜야 하는 포장방법에 관한 기준은 별표 1과 같다.
제4조의2(제품포장 자율평가 시스템)
① 제조자등은 포장폐기물의 발생을 억제하고 재활용을 촉진하기 위하여 제3조 및 제4조 따른 기준 준수 여부 등 환경친화적인 제품포장에 대하여 자율적으로 평가하는 시스템을 구축할 수 있다.
② 제1항에 따른 시스템을 구축하는 제조자등은 평가 내용 및 기준을 공개하여야 한다.
제5조(제품의 포장재질 및 포장방법에 관한 검사 등)
① 「자원의 절약과 재활용촉진에 관한 법률」(이하 "법"이라 한다) 제9조제3항에서 "기후에너지환경부령으로 정하는 전문기관"이란 다음 각 호의 기관을 말한다.
1. 「한국환경공단법」에 따른 한국환경공단
2. 「한국환경산업기술원법」에 따른 한국환경산업기술원
3. 「국가표준기본법」 제23조에 따라 인정된 시험ㆍ검사기관 중 기후에너지환경부장관이 지정하여 고시하는 기관
② 법 제9조제3항에 따라 제품의 포장재질 및 포장방법에 관한 검사명령을 받은 제조자등은 그 명령을 받은 날부터 20일 이내에 제1항에 따른 전문기관이 발행한 검사성적서를 검사를 명한 기관의 장에게 제출하여야 한다.
제6조(제품의 포장재질 및 포장방법의 표시방법) 법 제9조제4항에 따른 포장재의 재질 및 포장방법의 표시방법은 별표 2와 같다.
제7조 삭제
제8조(합성수지재질로 된 포장재의 연차별 줄이기에 관한 기준)
① 영 제7조제3호에 따른 제품의 제조자등이 지켜야 하는 합성수지재질로 된 포장재의 연차별 줄이기에 관한 기준은 별표 3과 같다.
② 기후에너지환경부장관은 제1항에 따른 기준의 이행 여부 확인 및 줄이기의 방법 등에 관하여 필요한 사항을 정하여 고시한다.
③ 기후에너지환경부장관은 제2항에 따른 사항을 정할 때에는 산업통상부장관과 미리 협의하여야 한다.
제9조(합성수지재질로 된 포장재의 연차별 줄이기의 예외) 제조자등이 제8조제1항에 따른 기준을 지킬 수 없는 경우에는 제품을 제조ㆍ수입 또는 판매하기 전에 다음 각 호의 서류를 기후에너지환경부장관에게 제출하여야 하며, 기후에너지환경부장관은 제출된 서류의 내용을 검토하여 그 결과를 서면으로 통보하여야 한다.
1. 제품의 종류ㆍ크기ㆍ형태 및 포장재질ㆍ포장방법을 적은 서류
2. 제8조제1항에 따른 기준을 지킬 수 없는 사유를 적은 서류
제10조(포장용기의 재사용)
① 다음 각 호의 제품을 제조하는 자는 그 포장용기를 재사용할 수 있는 제품의 생산량이 해당 제품 총생산량에서 차지하는 비율이 다음 각 호의 구분에 따른 비율 이상이 되도록 노력하여야 한다.
1. 화장품 중 색조화장품(화장ㆍ분장)류: 100분의 10
2. 합성수지용기를 사용한 액체세제류ㆍ분말세제류: 100분의 50
3. 두발용 화장품 중 샴푸ㆍ린스류: 100분의 25
4. 위생용 종이제품 중 물티슈류: 100분의 60
5. 분말커피류: 100분의 70
6. 크레용ㆍ크레파스ㆍ물감: 100분의 10
② 「유통산업발전법」 제2조제3호에 따른 대규모점포에서 제1항에 해당하는 제품을 판매하는 자는 제1항에 따른 포장용기를 재사용할 수 있는 제품을 진열ㆍ판매하는 공간을 확대하는 등의 방법으로 포장용기가 재사용될 수 있도록 협조하여야 한다.
③ 숙박업, 목욕장업, 연수원 등 다중(多衆)이 이용하는 시설을 경영하는 자는 포장용기의 재사용을 위해 노력하여야 한다.
제11조(포장제품의 재포장 금지) 다음 각 호의 어느 하나에 해당하는 자는 포장되어 생산된 제품을 재포장하여 제조ㆍ수입ㆍ판매해서는 안 된다. 다만, 재포장이 불가피한 경우로서 기후에너지환경부장관이 고시하는 사유에 해당하는 경우는 제외한다.
1. 제품을 제조 또는 수입하는 자
2. 「유통산업발전법」 제2조제3호에 따른 대규모점포 또는 면적이 33제곱미터 이상인 매장에서 포장된 제품을 판매하는 자
제12조(규제의 재검토) 기후에너지환경부장관은 제4조 및 별표 1에 따른 제품의 포장방법에 관한 기준에 대하여 2014년 1월 1일을 기준으로 3년마다(매 3년이 되는 해의 1월 1일 전까지를 말한다) 그 타당성을 검토하여 개선 등의 조치를 해야 한다.
부칙

이 규칙은 공포한 날부터 시행한다. 다만, 제3조제3항 및 별표 3 제2호의 개정규정은 2004년 1월 1일부터 시행한다.

①(시행일) 이 규칙은 공포한 날부터 시행한다. 다만, 제3조제1항의 개정규정은 이 규칙 공포 후 6월이 경과한 날부터 시행한다.
