Texas HB 2127 (Texas Regulatory Consistency Act) establishes broad state-level field preemption over municipal and county regulations across six major code areas: Agriculture Code, Finance Code, Insurance Code, Labor Code, Natural Resources Code, and Occupations Code. Any municipal or county ordinance, order, rule, or policy in a field occupied by any provision of these codes is void and unenforceable unless explicitly authorized by state statute. This directly eliminates local EPR, packaging, labeling, product stewardship, or waste-related ordinances that municipalities or counties may have enacted or planned. Producers, manufacturers, brand owners, and importers operating in Texas are no longer subject to a patchwork of local regulations in these code areas. Enforcement mechanism includes a private right of action (including by taxpayers) against municipalities, counties, or officials who adopt or enforce preempted regulations, with governmental immunity waived. Remedies include declaratory and injunctive relief plus attorney's fees. Actions may be filed in any county in Texas. The preemption applies to causes of action accruing on or after the effective date of September 1, 2023, or immediately upon two-thirds legislative vote.
