Any producer of gas cylinders supplied, sold, or offered for sale in Connecticut

Fee Structure

Flat: Commissioner may assess a reasonable annual administrative fee to each producer or producer's designee with an approved gas cylinder stewardship plan. Fee share is based on each producer's or producer's designee's share of the gas cylinder market. Total annual fees per producer shall not exceed $2,000. Commissioner must annually publish documentation on use of fees.

Enforcement

Connecticut Commissioner of Energy and Environmental Protection (DEEP); Attorney General: Civil penalty of not more than $25,000 per offense for each violation by a producer, imposed by superior court. Each violation is a separate and distinct offense. Court may also issue permanent or temporary injunctions, restraining orders, or other orders requiring remedial measures. Noncompliant producers receive a notice of noncompliance from the Commissioner. Gas cylinder stewardship organizations may bring civil action against noncompliant producers for actual costs exceeding $500 (administrative overhead, education, collection, handling, recycling, approved disposal) plus costs and reasonable attorney's fees.
