Obligations under this law

·Make available to independent repair providers and equipment owners, on fair and reasonable terms and costs, any documentation, parts, embedded software, firmware, or tools intended for use with the equipment or any part, including updates.
·With respect to equipment containing an electronic security lock or other security-related function, make available to independent repair providers and owners any documentation, parts, embedded software, firmware, or tools needed to reset the lock or function when disabled during servicing (may be provided through appropriate secure release systems).
·Provide documentation (including relevant updates) at no charge; may charge a fee for printed copies only covering actual cost to prepare and send.

·With respect to equipment containing an electronic security lock or other security-related function, make available to independent repair providers and owners any documentation, parts, embedded software, firmware, or tools needed to reset the lock or function when disabled during servicing (may be provided through appropriate secure release systems).
·Provide documentation (including relevant updates) at no charge; may charge a fee for printed copies only covering actual cost to prepare and send.
·Provide software tools at no charge, without requiring authorization or internet access, without imposing impediments to access or use, in a manner that enables full functionality and does not impair efficient and cost-effective performance.
·Price parts, embedded software, firmware, and non-software tools at no greater than manufacturer's suggested retail price, calculated using net costs accounting for discounts, rebates, or incentives, and on terms no less favorable than those offered to authorized repair providers.
·Not refuse to make available any documentation, part, embedded software, firmware, or tool on grounds that it is a trade secret (though may redact trade secrets from documentation if usability for repair is not diminished).
·Not enter into or renew contracts with terms that waive, avoid, restrict, or limit the manufacturer's obligations under this part after the effective date.

Exemptions

·Parts that are no longer available to the original equipment manufacturer.
·Conduct that would require the manufacturer to divulge a trade secret (but manufacturer cannot refuse to provide a documentation, part, embedded software, firmware, or tool solely on the basis that the item itself is a trade secret).
·Manufacturer may redact trade secrets from documentation before providing access, provided usability for repair is not diminished.
·Manufacturer may withhold information regarding a component, design, functionality, or development process of a part, embedded software, firmware, or tool if it is a trade secret and usability for repair is not diminished.
·Existing contracts or arrangements between OEMs and authorized repair providers (including warranty/recall work, exclusivity, and noncompete clauses) are not altered by this part.
·Manufacturers are not liable for faulty or improper repairs by independent repair providers or owners, including resulting damage, indirect/incidental/special/consequential damages, or reduced functionality.

Producer Definition

An original equipment manufacturer (OEM): a person doing business in Colorado engaged in the business of selling, leasing, or otherwise supplying new powered wheelchairs or parts manufactured by or on behalf of itself to any individual, business, or other entity.

Fee Structure

Unknown: No producer fee or stewardship fee structure established. Documentation must be provided at no charge (except actual cost of printed copies). Starting January 1, 2023, the act requires a manufacturer to provide parts, embedded software, firmware, tools, or documentation, such as diagnostic, maintenance, or repair manuals, diagrams, or similar information, to independent repair providers and owners of the manufacturer's powered wheelchairs to allow an independent repair provider or owner to conduct diagnostic, maintenance, or repair services on the owner's powered wheelchair.
