Covered Products

·Nonrefillable and refillable gas cylinders supplied to consumers for personal, family, or household use with flammable pressurized gas, helium, or carbon dioxide, with water capacity greater than one-half pound but not exceeding fifty pounds, including seamless cylinders, welded cylinders, and insulated cylinders containing helium, carbon dioxide, propane, butane, or other flammable compressed gases

Producer Obligations

·Notify the Commissioner in writing by January 1, 2023 of intent to act individually or jointly to submit a stewardship plan
·Submit a gas cylinder stewardship plan to the Commissioner no later than July 1, 2023
·Be part of an approved and implemented gas cylinder stewardship program no later than October 1, 2025
·Stewardship plan must provide for refilling or recycling cylinders and capturing residual gases for reuse
·Stewardship plan must establish performance goals for the first two years of the program
·Stewardship plan must identify eligible entities to be used under the program
·Stewardship plan must detail how the program will promote collection of discarded gas cylinders
·Stewardship plan must include a description of the public education program
·Stewardship plan must identify all participating producers
·Program must minimize public sector involvement in management of discarded gas cylinders
·Program must provide free, convenient, and accessible statewide collection opportunities at eligible entities
·Program must provide for pick-up of discarded gas cylinders from eligible entities
·Program must provide for transport and management of discarded cylinders consistent with law
·Submit updated performance goals to the Commissioner no later than 30 months after program implementation, based on first two years of experience
·Submit proposed substantial changes (material changes to the collection system) to the Commissioner for approval; deemed approved if not disapproved within 90 days
·Notify the Commissioner on an ongoing basis of other material changes (e.g., contact information changes, changes to stewardship organization board/officers) without plan resubmission
·Maintain all records relating to the gas cylinder stewardship program for not less than five years
·Submit an annual report to the Commissioner no later than October 15 of each year in a format prescribed by the Commissioner

Exemptions

·Cylinders, tubes, or containers intended to deliver a product that is not a compressed gas
·Medical or industrial-grade cylinders
·Cylinders used by any medical facility or commercial enterprise
·Cylinders containing oxygen, refrigerants, acetylene, hydrogen, ethylene, or foam adhesives
·Cylinders with water capacity of one-half pound or less
·Cylinders with water capacity exceeding fifty pounds
